Privacy Policy, Terms of Use, and User Agreement for OpsForge

A Local-First Business Operations, Checklist, Inspection, Records,

Reporting, Backup, and Restore Application

Developed and owned by Patriarch One LLC

This Privacy Policy, Terms of Use, and User Agreement ("Agreement")

governs use of the OpsForge mobile application ("OpsForge" or the

"App"). By downloading, accessing, purchasing, subscribing to, or using

the App, you acknowledge that you have read and agree to this Agreement,

subject to rights that cannot lawfully be waived or limited.

Data Collection and Local Storage

OpsForge is designed as a local-first application. Operational

information created in the App---including business configuration,

checklist definitions, checklist results, records, corrective actions,

notes, signatures, photographs, reports, and related settings---is

generally stored locally on the user's device unless the user

intentionally invokes an operating-system or third-party feature that

transfers, shares, saves, or backs up that information.

Patriarch One LLC does not operate an OpsForge cloud database for

ordinary business records unless a future version expressly introduces

such a service and this Agreement and applicable disclosures are updated

accordingly.

Apple may independently process information relating to App Store

purchases, subscriptions, device services, operating-system features,

crash reporting, or other Apple services under Apple's own terms and

privacy policies. Patriarch One LLC does not control Apple's independent

processing.

User-Controlled Files, Reports, Backups, and Exports

Users control the business information they enter into OpsForge and the

files they intentionally export or share.

OpsForge may permit users to generate or manage PDF reports, CSV

exports, photographs, signatures, and OpsForge backup files. When a user

chooses to save, export, share, AirDrop, upload, email, copy, or

otherwise transfer information using iOS, Files, iCloud Drive, external

storage, or another provider, the selected destination may be operated

by Apple or another third party.

Patriarch One LLC does not control the security, availability,

retention, transmission, privacy practices, or reliability of a

destination selected by the user. Users are responsible for verifying

that important reports and backups were successfully saved and remain

accessible.

Backup and Restore

OpsForge may provide local backup, verification, and restore

functionality intended to assist users in preserving or recovering App

data.

No backup or restore system can guarantee against every form of device

failure, storage corruption, operating-system failure, physical loss,

user error, interrupted transfer, third-party provider failure, or other

event outside the App's control.

Users are responsible for maintaining appropriate independent copies of

important business information and for verifying backups before relying

on them.

A restore operation may replace current local OpsForge data with the

state contained in a selected backup. Users are responsible for

reviewing the backup information and warnings presented before

authorizing a restore.

Patriarch One LLC is not responsible for loss resulting from deletion,

loss, corruption, modification, mishandling, or unavailability of a

user-controlled backup or destination, except to the extent liability

cannot legally be excluded.

Connectivity and Offline Operation

OpsForge is designed to provide substantial local functionality without

continuous internet connectivity. However, some features may depend on

internet access, local-network availability, Bluetooth, Apple services,

App Store services, device permissions, connected accessories,

third-party equipment, or operating-system functionality.

Patriarch One LLC does not warrant uninterrupted connectivity or

continuous availability of any network-dependent, Bluetooth-dependent,

accessory-dependent, Apple-dependent, or third-party-dependent feature.

Users are responsible for maintaining suitable device connectivity when

a feature requires it.

Loss of Wi-Fi, cellular service, local-network access, Bluetooth

connectivity, internet service, Apple service availability, accessory

power, device permissions, or third-party service availability may

delay, limit, or prevent affected features from operating.

Offline operation does not guarantee that every feature will remain

available. Features requiring verification, synchronization, purchases,

subscription status, external accessories, system services, or

third-party resources may require connectivity before they can complete.

To the fullest extent permitted by law, Patriarch One LLC is not liable

for operational delays, missed communications, unavailable

network-dependent functions, delayed subscription verification,

accessory disconnections, or similar consequences caused by connectivity

conditions or services outside Patriarch One LLC's reasonable control.

Bluetooth, Local Network, Devices, and Accessories

Future or current versions of OpsForge may communicate with supported

devices, accessories, Bluetooth peripherals, local-network equipment,

printers, scanners, sensors, thermometers, barcode readers, or other

compatible hardware.

Compatibility is not guaranteed with every device, firmware version,

network configuration, accessory, manufacturer, or operating-system

release.

Users are responsible for verifying that connected equipment is

appropriate, calibrated where necessary, maintained, powered, secured,

and suitable for the user's intended purpose.

OpsForge must not be relied upon as the sole means of determining

whether safety-critical, medical, regulatory, food-safety, industrial,

or other regulated equipment is functioning correctly.

Patriarch One LLC is not responsible for failures caused by unsupported

equipment, manufacturer changes, firmware changes, wireless

interference, signal range, low battery, equipment malfunction,

inaccurate accessory readings, network configuration, or third-party

hardware/software, except where applicable law provides otherwise.

Operational Checklists and Business Records

OpsForge is an operational assistance and recordkeeping tool. It does

not replace professional judgment, employee supervision, regulatory

compliance programs, legal advice, safety procedures, manufacturer

instructions, health-code requirements, industry standards, or other

obligations applicable to a user's business.

Users are solely responsible for determining which checklists and

procedures are appropriate, which employees or managers may perform

work, whether responses are accurate, whether corrective actions are

sufficient, whether equipment readings are valid, whether required work

has actually been performed, and whether records satisfy applicable

requirements.

Templates, recommendations, schedules, alerts, suggested procedures,

generated reports, or other App content are tools for organization and

documentation and are not certifications of compliance.

User-Entered Information

Users are responsible for the accuracy, legality, appropriateness, and

completeness of information entered into OpsForge.

Patriarch One LLC does not independently verify user-entered checklist

responses, photographs, signatures, measurements, corrective actions,

employee statements, dates, notes, business information, or other

records.

A completed checklist or generated report reflects information recorded

through the App; it does not independently establish that an underlying

event occurred exactly as recorded.

Photographs, Signatures, and Evidence

Users are responsible for obtaining any permissions or consent required

before capturing, storing, exporting, or sharing photographs,

signatures, employee information, customer information, or other

evidence.

Users must not use OpsForge to unlawfully record, store, disclose, or

distribute information.

Reports and Exports

Reports, summaries, charts, CSV files, PDFs, and other generated outputs

are based on information available to OpsForge at the time of

generation.

Users are responsible for reviewing reports before relying on,

distributing, filing, submitting, or using them for business,

regulatory, employment, insurance, legal, tax, safety, or other

purposes.

Patriarch One LLC does not guarantee that a generated report will

satisfy the requirements of any particular regulator, customer, insurer,

auditor, contract, jurisdiction, or industry standard.

Notifications, Alerts, Reminders, and Scheduling

Notifications, alerts, badges, reminders, schedules, and similar

features are convenience tools and must not be the sole mechanism relied

upon for time-sensitive, safety-critical, regulatory, medical,

food-safety, security, or other critical obligations.

Delivery and timing may be affected by iOS settings, Focus modes,

notification permissions, battery conditions, device state,

operating-system scheduling, connectivity, user configuration,

subscription status, or other conditions outside Patriarch One LLC's

control.

Users remain responsible for performing and supervising required work

regardless of whether an alert, badge, sound, reminder, or notification

is received.

Subscription and Free Trial

OpsForge may offer auto-renewing subscriptions through Apple's App

Store.

Subscription pricing, introductory offers, eligibility, billing,

renewals, cancellations, refunds, billing retry, grace periods, and

transaction processing are administered through Apple and are subject to

Apple's applicable terms and App Store systems.

Where offered, a free trial begins only after the user affirmatively

starts the applicable subscription through Apple. Eligibility for an

introductory offer is determined through applicable App Store

mechanisms.

Unless cancelled in accordance with Apple's procedures, an eligible

subscription may automatically renew at the price displayed by Apple at

the time of purchase.

Users can manage or cancel eligible subscriptions through their Apple

account or Apple-provided subscription-management interfaces.

Patriarch One LLC does not directly process App Store payment-card

information.

Subscription Expiration and Historical Data

If an OpsForge subscription or trial expires, OpsForge may restrict the

creation of new operational work while continuing to provide access to

existing historical records, reports, exports, backups, restore

functions, settings, and other designated read-only or data-management

features.

Expiration of a subscription does not transfer ownership of user-created

business records to Patriarch One LLC.

The exact features available without an active subscription may change

in future releases, subject to applicable law, App Store requirements,

and disclosures presented to users.

No Guarantee of App Store or Subscription Availability

Patriarch One LLC does not control the App Store, Apple ID services,

StoreKit, Apple payment processing, subscription verification

infrastructure, or Apple account systems.

Temporary inability to purchase, restore, verify, manage, renew, or

access subscription-related functionality may occur because of Apple

service availability, account status, connectivity, billing issues,

operating-system conditions, or other factors outside Patriarch One

LLC's reasonable control.

Device and System Requirements

Users are responsible for maintaining a compatible Apple device,

supported iOS version, sufficient storage, appropriate permissions, and

adequate power and connectivity.

Future iOS releases, Apple hardware changes, security policies,

third-party changes, or discontinued system functionality may affect

compatibility.

Storage Capacity and Data Integrity

Users are responsible for maintaining sufficient free storage on their

devices.

OpsForge may provide storage-health information, warnings, or capacity

checks, but such tools are estimates or operational safeguards and do

not guarantee that a device, filesystem, database, external destination,

or operating system will never experience failure or corruption.

Users should maintain appropriate verified backups of important records.

Security and Device Access

Users are responsible for securing their devices, Apple accounts,

passcodes, biometric access, exported files, backups, and third-party

storage destinations.

Manager authentication, Face ID, Touch ID, passcodes, and similar

operating-system mechanisms depend on Apple-provided security

functionality. Patriarch One LLC does not control biometric enrollment,

authentication availability, device compromise, or operating-system

security.

No Medical, Legal, Regulatory, or Professional Advice

OpsForge is not a medical device, legal service, regulatory authority,

accounting service, certification body, or professional consulting

service.

Information, templates, calculations, schedules, reports, reminders, and

workflows provided by the App are organizational tools only.

Users should obtain qualified professional advice when required.

Prohibited Use

Users may not use OpsForge to violate applicable law, infringe

third-party rights, bypass security controls, falsify records,

unlawfully monitor individuals, interfere with networks or devices,

distribute malicious content, or use the App in a manner that creates

unreasonable risk to persons, property, or systems.

Intellectual Property

OpsForge, its software, branding, design, original templates,

documentation, and other proprietary materials are owned by Patriarch

One LLC or its licensors and are protected by applicable

intellectual-property laws.

This Agreement grants users a limited, non-exclusive, non-transferable,

revocable right to use the App in accordance with this Agreement and

applicable App Store terms.

User-created business data remains the user's data, subject to rights

necessary for the App to process that information locally at the user's

direction.

Third-Party and Apple Services

Apple, iOS, App Store, StoreKit, iCloud, Files providers, device

manufacturers, accessory manufacturers, internet providers, wireless

networks, and other third-party products or services are not controlled

by Patriarch One LLC.

References to third-party products or compatibility do not constitute a

guarantee, endorsement, or warranty of continued compatibility.

Third-party terms and privacy policies may apply separately.

No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OPSFORGE IS PROVIDED

"AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR

IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A

PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY,

RELIABILITY, OR FITNESS FOR A PARTICULAR BUSINESS, SAFETY, REGULATORY,

OR COMPLIANCE PURPOSE.

PATRIARCH ONE LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED,

ERROR-FREE, SECURE, COMPATIBLE WITH ALL DEVICES OR ACCESSORIES, OR FREE

FROM DATA LOSS.

Nothing in this Agreement excludes warranties or rights that cannot

lawfully be excluded.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PATRIARCH ONE LLC AND

ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS,

AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL,

SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST

PROFITS, LOST REVENUE, BUSINESS INTERRUPTION, LOST OR CORRUPTED DATA,

MISSED TASKS, MISSED NOTIFICATIONS, FAILED CONNECTIVITY, DEVICE OR

ACCESSORY FAILURE, REPORTING ERRORS, LOSS OF EVIDENCE, OR COSTS OF

SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO USE OF OR INABILITY TO

USE OPSFORGE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGGREGATE LIABILITY ARISING FROM

OR RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT THE

USER PAID TO PATRIARCH ONE LLC THROUGH THE APP FOR THE TWELVE MONTHS

PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) TEN U.S. DOLLARS

($10.00).

Some jurisdictions do not permit certain exclusions or limitations, so

some provisions may not apply.

Business Continuity

OpsForge should not be the sole repository or sole control mechanism for

information or procedures whose loss or unavailability could cause

material harm.

Businesses are responsible for maintaining appropriate continuity

procedures, independent backups, employee training, emergency

procedures, and alternative methods for completing legally or

operationally required work if the App or device is unavailable.

Indemnification

To the extent permitted by applicable law, users agree to indemnify,

defend, and hold harmless Patriarch One LLC and its members, managers,

employees, contractors, affiliates, licensors, and service providers

from third-party claims, liabilities, damages, judgments, losses, costs,

and expenses, including reasonable attorneys' fees, arising from or

related to unlawful or unauthorized use of the App, user-entered

information, violation of this Agreement, violation of third-party

rights, misuse of exported information or backups, failure to obtain

required permissions or consent, or use of the App contrary to

applicable laws, regulations, professional obligations, or safety

requirements.

This provision does not require indemnification for matters for which

indemnification cannot lawfully be required.

Force Majeure

To the extent permitted by law, Patriarch One LLC is not responsible for

delay, interruption, or failure caused by events beyond its reasonable

control, including internet or cellular outages, Apple service outages,

operating-system changes, hardware failures, natural disasters, utility

failures, labor disruptions, cyber incidents affecting third-party

services, governmental actions, or failures of third-party

infrastructure.

Updates and Changes

Patriarch One LLC may modify, update, discontinue, add, or remove App

features in future releases.

This Agreement may also be updated to reflect changes in the App, law,

App Store requirements, business practices, or available functionality.

Where required by applicable law, material changes will be communicated

appropriately and consent obtained where required.

Continued use after an updated Agreement becomes effective constitutes

acceptance only to the extent permitted by applicable law.

Eligibility and Authority

Users must have legal capacity to enter this Agreement.

If the App is used on behalf of a business or organization, the

individual accepting this Agreement represents that they have authority

to bind that organization to the extent permitted by law.

OpsForge is not specifically designed as a children's application.

Governing Law and Venue

To the extent permitted by applicable law, this Agreement is governed by

the laws of the State of California, without regard to conflict-of-law

principles.

Subject to any rights or forums that cannot lawfully be waived, disputes

arising from this Agreement or the App will be brought in an appropriate

state or federal court located in California.

Nothing in this section eliminates consumer rights or mandatory venue

protections that apply under governing law.

Severability

If any provision of this Agreement is found unenforceable, the remaining

provisions will remain in effect to the fullest extent permitted by law,

and the affected provision will be interpreted or modified to the

minimum extent necessary to make it enforceable where permitted.

Entire Agreement

This Agreement, together with applicable Apple/App Store terms and any

additional terms expressly presented for a particular feature or

subscription, constitutes the agreement between the user and Patriarch

One LLC concerning OpsForge, except where applicable law requires

otherwise.
